Talaq joke on Skype ends marriage

 

Talaq is no joke. An e-savvy Qatar resident learnt this the hard way when he typed talaq thrice while chatting with his wife on Skype. He says he did not mean it but Dar-ul-Uloom Deoband has ruled that his nikah stands terminated. 



That's not all. For his careless 'chat', the man can remarry his divorced wife only after halaala, a practice under which the woman has to marry and divorce another man before she can marry her previous husband again. 



Deoband's fatwa section — Dar-ul-Ifta (DuI) — recently received a written request from Qatar, seeking a fatwa on a rather amusing situation. The youth stated that he was recently chatting with his wife on Skype when he typed the word 'talaq' three times, though he did not mean it and asked if his nikah was still valid. 



Dar-ul-Ifta shot back that the nikah stands terminated. "When you pronounce talaq three times, it means talaq has taken place, and it does not matter whether the woman has reciprocated or not. Your wife has become 'haraam' for you whether you are aware of the commandment of Islam or not. You neither have the right to take her back nor solemnise new nikah with her without a valid 'halaala'. After the completion of 'iddah' (iddat) period, the woman can marry where she wishes except you," the seminary said. 



As per senior Islamic scholars, 'halaala' requires the woman to complete her iddat period of 40 days beginning immediately after talaq. During this period she is supposed to stay away from celebrations and socialising. 



At the end of iddat, she would have to marry another man who should then divorce her. She will be required to go through another round of iddat only then would she be eligible to marry her "first husband".

Not only the divorced has to remarry another person [and divorce him] but also should have had s*x with him. So she may get a child also from the other man.

Fortunately for me no priest can dictate any terms to me because I am not a Muslim. This is the Azaadi which Kashmiri separatists and Arundhati Roy are fighting for.

Hmm, am sensing the technology waive of the future, People are divorcing on phones, video conferencing and now this skype. Don't know whts their is in the future

I do not understand one thing. If they were joking on Skype, it was their personal space. So who revealed this Talaq joke to the priest? If they had not done it, they would not have been affected at all. How the Priest got into the Skype conversation of both. Admittedly it was a joke, so why it did not remain a joke with the couple and why did they feel need to reveal this personal joke in the public??????

Probably a conspiracy by husband to divorce his wife, but keeping his conscience free from any guilt . Otherwise there was no necessasity to discus jokes with 3rd parties. Moreover such rules of divorce where the husband has absolute authourity and rights for divorce, reflect from the social order of times when women where not considered as free humans with equal rights but a matter of property with no practical rights, usually taken as prisoners, slaves after victory in war etc. Hence it is not uncommon to find intelligent and educated girls and their parents, opting for Special Marriage Act instead of other forms of marriage in order to protect their daughter from arbitray and capricious behaviour for divorce by husband.

i think skype , yahoo messenger and gtalk shud filter world talaq from their conversations to avoid such a situation.

Yes this word "Talaq" should be filtered.

If someone else other than her husband who knows the ppwd, wirte/type triple talaq word, then will divorce be effective?

apart from ignoring fatwa, he should have lied that some one else has typed, so many of his friends could have come to his rescue.

If he has the courage, which as a devout Muslim  he wont have, he should register his marriage under theSpecial Marriages Act'
