Daughter's right in Agricultural Property

Hi,

I have two maternal sisters ( Mother's brother side) whose mother had died in the year 1888. Father remarried a widow ( having one son from previous marraige) in 1991-92. Father died in the year 1993 under suspicious circumstances.

One part of land was named to her son.

He started selling this property last year when these sisters asked for their share he refused outroghtly in front of elders.

They filed  a case in Tehsil and the Tehsil gave judgement that name of son to be removed and the whole property to go to Wife's name as per Article 171 of Zamindari Act.

We know that there is amendment to Hindu succession law 1956 in 2005 according to which daughters have equal share in Father's property as their mother or brother.

 

The case is of UP Ghaziabad and we are Hindu by religion.

The Hindu Succession amendment act 2005 applies from the date of 20th nov 2004. A hindu daughter is a coparcener like she has had been a son. She has all rights & obligations like a son. She is inherited property of her mother and father as like son.
