Hon'ble SC has held that in S.138 NI matter, a Court can impose fine payable as compensation to complainant without awarding jail sentence.

Accused must fight it out in court since most of the cases are by loan sharks, there are so many techmicalities in the act and procedure which can be used to demolish any NI 138 case.
