Validity of a Rent Agreement

Is a deed of agreement done only between the Landlord & the Tanant Valid in court,

if it is done on a DALIL..... 

..... and is not registered in the registry / sub registry office ?

 

What is the required Revenue cost of the Dalil for such deeds of agreements ?

No Sir, I don't have such a deed. I am asking for my knowledge.

 

 

An Eleven month deed for Lease of Room done between a Landlord & Tanent at home, with witnesses, on a Rs.20/- Dalil.... But the agreement is NOT Regd. on the sub registry / Registry office after the signing ups. So will such an agreement be Valid in Court ?

Any NEW CURRENT LAWS that such agreements SHOULD be registered ?

 

 

Furthermore, what should be the Prices / Value of such a Dalil, for such an agreement ?

registration is not at all necessary. such type of deed is certainly a substantially valid one in court of law. that too the deed is made out for 11 months. if such agreement stands for morethan a period of 1 yr then the court will ask for payment of higher registration fee while its marked as a document.

There are several documents which are not compulsorily registerable under Section 17 of the Registration Act. So eleven months deed for Lease is perfectly O.K. There is no need to register it in sub-registrar office. It is admissible in evidence.

Lease deed for less than one year amongs the documents that do not require registration.

What Prices/Value of Dalil is required, for such an agreement ?

even for knowledge please note that certain provisions  of law come in picture only after happening of the event.

Once a tenat enters in the place it is defficult to evict him or get any agreement done from him. It is just like a toothpaste tube; once the paste is out you can not put it in.

Lease deed if properly stamped and is not for more than 11 months it need not be registered.(Sec. 106-107 of the T.P.Act.  For Dalit see Sec. 9 of the Stamp Act where in Govt. gives remissions to a class of persons. Whether the state in which you live has exampted Dalit from stamp duty please go throught the notification in this regard.

... and if it a deed which requirs registration you may get benefit to some extent U/s. 49 of the Registration Act.

Sir, can you plz guide about it... that is applicable in the state of Assam. 

I have asked various local Lawers & Advocates, strange... as everyone gave a different answer regarding the Price / Value for such a Dalil.

IN MAHARASHTRA ELEVAN MONTH OF LEASE IS COMPULSARILY RERGISTERED.FOR NONREGISTRATION OF THE SAID DOCUMENT LANDLORD CAN BE CRIMINALLY PROSECUTED ALSO.

Yes it is essential in Maharashtra rent act.
