Security personel regularisation

Dear Sirs,

Please advise me in the following case.

Our plant is having nearly 70 No.s of security guards are working since last 15 years as a contract labour. We are paying wages through a private security contractor as per the minimum wages stated in gavernent gazette. From last Eight years they are working under M/s.Hawk securities and the said contract is going to be terminated from February'2012 onwards. The company has engaged a new contractor, the new one wants to recruit new security guards.

Now, the secutiry guards are demanding for their regularisation through company rolls. They have gheraoed the site officials without prior intimation and had given one day time to settle the issue othetwise, they will take up this issue as political issue. But management has no idea to regularise them, but they can give assuarance that, in new security contract also same guards will be taken.

Please advise what are the steps have to be taken by management to settle this issue with security personnel.

Is the existing contract duly registered and the contractor has taken license. Even otherwise, a peaceful solution can be given by accommodating the labour by the new contractor. In such case the past benefits including gratuity are to be settled for which the company should provide a fair solution. The new contractor should get proper license.

Mr.Vasudevan has given a valid suggestion. You need to have a valid license and need to settle the benefits what are eligible under law with the previous contractor.

One suggestion is better avoid the existing people as they have the point of regularization in their mind even if the new contractor is ready to take all the existing people better to reshuffle over a period of time otherwise the same scenario continues and the contractor simply raise his hands saying that with your compulsion only I have inducted all the existing security staff. If it costs more also slowly ask the contractor to deploy the security staff to some other sites where they have the contract.

As far as regularization is concerned you don't have any liability and your management need to be tough in deeling with the politicians and other people.

Mr. Vasudevan has a wise and balanced advice.

The business house should adopt a businesslike approach and peruse a businesslike solution.

 

The new contractor shall be getting a big contract and shall file in line for solution suggested by your company.

dear sir

 

If your factory is located in Maharashtra, you have to recruit registered security guards as per the Maharashtra Private Security Guards act.
