Whether notarised General Power of Attorney granted by a Pvt. Limited Company (Landowner) in favour of a Developer (Construction Firm) in West Bengal vests legal right in the Developer for sale of property (flats)? Here the Developer is the "Vendor/Developer" (First part,) Purchaser is the Second part, and the Pvt. Limited Company represented by the Developer (Constituted Attorney) is the Owner/Confirming party (Third Part). In this particular case the Pvt. Ltd. Co. grants power to the Attorney (Developer Firm) for sale of property! Whether the GPA must be compulsorily registered for selling proerty by Developer from its allocation? Sale of many flats of the building from Developer's allocation have been registered and home loan sanctioned by financial institutions.
