Extra marital affair will be a ground for divorce.

Saurabh..V (Law Consultant)     23 September 2013

@Author A married man cannot live with another women legally nor can he indulge into extra marital relation but can continue to engage into such relationship unless the former's wife comes to get hold of crucial proofs of this relationship. Legally this is an offence but otherwise unless not dragged by the wife in bigamy for divorce, anyone can enjoy extra marital relation. This liberty is available even for wife. But morally and personally speaking this is something extra-terrestrial for our society and not acceptable in India as of now.

1.your friend is knowengly indulging and doing wrong socially and legally,2. The wife of your friend can file divorce on The ground of cruelty because her husband is indulged in illicit relation with some other married woman. 3. The husband of The second married woman can file a case of adultry u/s 497 ipc against your friend.and once proved in The court a punishment of 5 years is awarded to your friend .so pl. Stop your friend if you don't want your friend behind The bar.

What proofs are accepted as evidence in court for IPC 497?

T. Kalaiselvan, Advocate (Advocate)     23 September 2013

Shaliniraj, Unfortunately the law punishes only the male offender for an offence under adultery, hope your friend who is morally liable, can sigh a relief.

Dear Dinesh Read section 497 of IPC 497. Adultery.-- Whoever has s*xual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such s*xual intercourse not amounting to the offence of rape, is guilty of the offence of adultery, and shall be punished with imprisonment of either descripttion for a term which may extend to five years, or with fine, or with both. In such case the wife shall not be punishable as an abettor.

Married or unmarried male cannot have s*xual relationship with married woman [ Except with consent- permission of her husband]

It is illegal immoral, and dangerous to society, as well as to persons involved. JUST AVOID SUCH RELATIONSHIP.
