can the person making those unproven allegations be penalized ?
Suchitra. S (Advocate) 06 November 2009
Court decides whether the allegations are proved or not and punishes the offender if proved or may acquit him if allegations not proved. Then it is the decision of the person aquitted to file a suit for defamation for evrything he had to suffer from the person alleged. But it is not worth making trips to court for that after one has been aquitted. :)
