Dear all Members,
My client's wife has lodged a complaint with CAW Cell where ACP is pressurising my client to get load the dowry articles & submit it with CAW Cell. A s per ACP's statement the wife is not ready to resettle her married life. But the husband is still ready. He is stating that if he returns the dowry articles of submits the same with CAW Cell it would be considered that he doesn't want to resettle his married life. What should he do? Plz advise as urgent.

List of articles need to be prepared and given by her. All articles submitted in court or PS needs to be acknowledged/photgraphed and weighed. Objections to any articles need to be prepared and acknowledged. Only Stridhan articles need to be given if any.
also, you can give undertaking that you will give it to her personally in court and articles listed/acknowledged. 498a is coming. PWDA also. Ask him to apply AB immediately.

He should made his statement and record it and get the copy of the same from the cell that he is ready to return but he dont want divorce, so want to settle the matter amicably or through court.
Dont worry noting will happen. At most they can only register a case u/s 498 and 406 noting more than this and for that he may get the "AB". Anticipatory bail in advance and safe himself and his family members.

REGARDING THE COMPLAINT TO THE DSP AND PROTECTION OF HUSBAND KINDLY NOTE THAT.
1.YOU MAY SEEK PROTECTION FROM THE DIST AND SESSIONS COURT FOR THE HUSBAND BY GETING ANTICIPATORY BAIL AND INTERIUM ANTICIPATORY BAIL.
2.KINDLY DO NOT ADMIT OR PRODUCE ANY ARTICLES AS IT WILL AMOUNT TO ADMISSION OF THE CHARGES.
3.ONCE YOU GET ANTICIPATORY BAIL FOR THE SAID HUSBAND ,THE SAID PERSON WILL BE SAFE. TAKE PRECAUTION AND ADVISE THE HUSBAND IN THE CASE NOT TO GO TO THE POLICE STATION AND STAY AT DIFFERENT PLACE THAN USUAL RESIDENCE TILL ANTICIPATORY BAIL IS GRANTED.
4.YOU CAN FACE THE TRIAL IN THE COURT ONCE THE ANTICIPATORY BAIL IS ALLOWED.
