Query on gratuity

It has been six years since my father expired i.e on 2011.He worked as senior assistant in industries dept ap state govt..till we haven't received the gratuity amount.We went to the office so many times but no one cares to respond..one of the officials said Then because of telangana--andhra pradesh issue it was said that it is under process..now we even dont know at what stage the process is or where the file is.. How or where can we get any information about it?? can rti be of any help??

Adress an RTI query  to the PIO of the concerned  Department u/s6(1) of RTI act AND GET THE REQUIRED INFORMATION.IF YOU APPRECIATE THIS ANSWER PLEAE CLICK THE THANK YOU BUTTON ON THIS FORUM.

Immediately file application to the designated Gratuity officers , Public Information officer (RTI) and seek specific reasons for the delay of sanctioning Gratuity  to late.......retired/expired as..............(desination) at..............office , for application filed on..............................

After receiving the information issue a legal notice to Gratutiy officer demanding for payment of gratuity within 15 days.

Then file complaint before concerned Labor Court or Distrit Consumer Forum where the total costs may not exceed Rs.500/- in total.

Contact the NGGO Association or concerned employee's union or retiree's association for their support in getting early claim.

There is no prescribed format of application and the RTI Application may be in the form of a letter, and affix Rs.10/- Adhesive Court fee stamp as RTI fee.

Download Gratuity Rules of the establishment.

Do you have Gratuity Rules of the establishment.?

Did you inform death and submit death certificate?

Do you have acknowledgment?

Has the dept. recorded death?

Has the Dept. paid other dues?

Who was paid ; you?

Usually the employer duly records nomination in service record.

Who was nominee?

Labor Court, Consumer Forum may not be the forum to claim in such case.

Claim may lie before the Controlling Authority.

Before that querist may reply pointwise to all points.

 

You may also inform did you ever write to dept under acknowledgment?

 

Don't worry, we will try to support for the gap of 6 years also.

Once you go through the  ap state service rules and then only you have proceed with all the department acknowledgement and fille case in RTI  to get the information above said quarry.

Employer is under obligation to supply the  notice of determiantion of Gratuity and payment when it has become due.

There is NO limitation.

As per the information furnished,your father expired in the year 2011 and did not receive the Gratuity so far. First of all, you make out a Application to the Asst. Labour Commissioner, Hyderabad if your father retired in Hyderabad- Telangana Region with all the documents/information as laid in the Payment of Gratuity Act,1972 --for details you may purchase Bare Act and proceed further. for further details if you can send information , please send to seshavikarala@yahoo.com
