Rti query

Dear Legal Team,

Is there any option to seek reason, if revenue authority considers property as dispute?

Can we ask concerned revenue authorities for which reasons did they consider property as dispute ?

Pls advice

There must be a noting in the revenue record if some legal dispute regarding that property will be officially into the knowledge of revenue authority. Therefore, there is no need to apply under RTI Act, rather get a certified copy of the revenue record through ordinary procedure.

The right to information is confined to seeking that information available on record.  In this case the Revenue Authorities considered this as dispute.

They have to provide reasons and even provide such cerrtified copies if it is requested by Applicant.

As per Sec.4 (d): "Provide reasons for it's administrative or quasi judicial decisions to affected parties"

You can file application and seek information as follows:

1)Please provide me specific reasons on record, with such certified copies on which authorities decided that there is a property dispute in property no......................................

2.Please provide copy of extant of rules/circulars/notifications/orders that empower the authorities to refuse/rejecct a bonafide claim with such reasons, without proper and valid orders from Court, and only on mere complaint from citizen.
