Advancing of civil case without following due procedures....

Is the advancing of civil case hearing allowed without the basic compliance of submitting proof of service of notice to other side?!

You file a Writ of Mandamus in Highcourt against the civil court seeking  directions  to civil court      not to advance the case without following the set procedure.

Thanks Ms. Usha... Is it Writ CERTIORARI under Article 227 of Constitution of India... That means to say civil court has done big procedural lapse without following the process of natural Justice... Regards Raj

All writs fall under  Article 226 and not Article 227 of Constitution of India as far as Highcourt is concerned..You can file either writ of Mandamus or Writ of Certiorari.
