Telecom Disputes

Dear Members,

It is time all the members should think a way of we jointly send a repressentation to Government to to take suitable action to bring the Telecom disputes back to to the jurdiction of consumer courts. I am attaching a file that was a news from Times of india on the subject

 Go to Article Telecom Services and Consumer Law where a Judgment passed by District Consumer Forum Ferozepur is placed on file wherein the forum has diwscussed the vast scope of Consumer Foras under the Consumer Protection Act.

 

Infact BSNL has mis represented the case before the Hon'ble Supreme Court of india when it was submitted that the provisions of Section 7B for appointment of an Arbotrator can prevail upon the decisions and jurisdiction of Consumer Foras. 

Infact, the Central Govt. has already decided as a Policy matter that no dispoute shall be referred to an arbitrator unless and untill a court of competent jurisdiction order to appoint an arbitrator. 

So, if the dispute between the Telecom service provider and a consumer is that of a minor amount of Rs.3-4 or 10-20 tyhousands, it will take much more time of 2-3 years in a court to appointment of arbitrator and the procedure will prolonged a lot which will frustrate  the innocent consumer.
