It is the legitimate right of the landlord to recover outstanding rent whether the premises is being governed by the provisions of State Rent Control Act or Transfer of Property Act.

Eviction of tenant for outstanding rent depends upon the provisions of respective State Rent Control Act wherein the demised premises is covered to protect the tenant or not.

The owner of property can recover possession of the demised premises by eviction of tenant for renovation or reconstruction, if it is governed by the provisions of Transfer of Property Act.
However, if the premises is situated/governed by provisions of State Rent Control Act permission for eviction shall be granted by Rent Controller for specific period i.e., till the building is re-constructed/renovated.
