Writing a will

My father filed partition suit in court. By mistake he also kept his and my mother self acquired property in the Partition suit. We asked lawyer to remove that from suit properties. Before removing from court they can write a will or sold to someone. Please suggest me.

Property partition is subject to the inheritance law. ... This share goes out of the purview of ancestral property. Partitions of self earned property cannot happen during life time of to person who earned.

 

It is mistake can be correct in court papers.
