Can a person living abroad purchase an immovable property through GPA

A a person living in usa is willing to buy a property in hyderabad in telangana state of india through gpa.
can he do so ?
if yes what the complete procedure for it ?

Yes but to purchase any land here he must execute a purchase gpa in India in favour his direct family member and it must be registered

'Buyer Beware' applies to property deals.

It shall be appropriate to get proper legal opinion from a very able LOCAL senior counsel of unshakable repute and integrity specializing in revenue/property/civil/DRT matters and well versed with LOCAL applicable rules/laws and having successful track record…. and worth his/her salt , before signing or making payment.

This may cost some FEE but can defend long term interest and hard earned monies.

Probably you are referring to person of Indian Origin residing in USA.

Pursue RBI guidelines, Def. of NRI in FEMA.Funds remitted thru banking channels, NRE/NRO/FCNR a/c  are required or option of home loan me be explored.

NRI may be able to but residential and commercial property and may not be able to buy agricultural land.

The buyer may give PoA ( General/Specific for the purpose) to a person residing in India and PoA may be executed on stamp paper as per requirements of country say;USA, attested by Indian Embasy/consulate. The PoA may be adjudicated within specified time e.g; 3 months in India.

Your counsel in India can help you to complete all such formalities.

You may take help of elders of your family, competent and experienced well wishers, seasoned PIP’s, helpgroups, community leaders, NGO’s, experienced colleagues, associations, etc and  find a very able LOCAL counsel/Law firm specializing in concerned filed of law e.g; Revenue/Civil matters as in your case, and well versed with LOCAL applicable rules, precedence, latest judgments etc …. and worth his/her salt, can advise you after examining all case related docs, inputs,  evidences on record.

One should not fall for IT’s and entities loitering at online portals to allure unsuspecting querists. There are many threads on such instances at LCI also.
