leakage causes dampness

1) If the external pipes of the building are damaged which results in dampness of the house, is it the societies/RWA's liability to get it fixed? Should it be covered in the maintenance that the flat owner pays?

2) If the pipe of a particular house has leaked which has resulted in damps in the adjoining house, on who is the liability of the damp affix upon?

Q.1- It is the liability of the society/RWA to get the problem fixed.
Q.2- It is the liability of the adjoining house owner to get his pipes repaired. If he refuses, then send legal notice to him to get the pipes repaired. Feel free to contact at sunayana122@gmail.com for further assistance.

Before forming an opinion qua your question you are required to clarify whether the damaged house is forming part of a Cooperative Housing Society or Owners Apartments Association or Residents Welfare Association responsible for external maintenance ???

What are the ingredients of maintenance i.e., services provided out of maintenance fund of the CHS / OAA /RWA concerned as provided in respective Act, Rules and Bye-Laws of CHS and MoA & AoA of Association?
