Eligibility for gratuity at 4 years and 190 / 240 days. As per Section 4(1) of the Payment of Gratuity Act 1972, an employee becomes eligible for gratuity only after completion of 5 years of continuous service with the same establishment.

Yes. Eligibility for gratuity is 5 years and if 4 years and 240 days will be completed also eligible for it.

1. Send Form I claiming grauity through registered/ speed post to the employer and wait for 30 days.
2. If the employer does not pay within 30 days, then you may file a case in Form N before the Controlling Authority under the Payment of Gratuity Act.
