Job while doing regular degree course

Mr. A has done his regular B.Tech degree from XYZ University ,while doing regular Job in Central govt Institute on outsourcing basis,without any permission from his deptt.

My Queries are:-

1. Is it attracts a crime,if yes which IPC or CrPC.

2.is liable for disciplinary proceedings.

3.He might be expel/fired from his job or not.

4.Supression of facts is a misconduct on the part of a government contract employee, which call for disciplinary action and eventual removal from service, if proved guilty.pls guide.

 

Pls all expert guide for same.

1. No. 2 to 5: The employee will be removed from the Services when noticed by the department concerned.

Since the work is stated to have been "outsourced" by the department to a contract, terms and conditions of contractor (but not Departmental / DoPT) shall apply wherein the contractor is least concerned till you are working to his/her satisfaction. No such bar / restriction is there to pursue higher studies during your personal time without permission of contractor.

1.It is not a crime or irregularity for an outsourced employee, but it may be improper for a regular employee. But, it can not be said proper, if the employee suppressed his status in his application before the engineering college. That is a different issue. 2.The outsourced employee is not a regular employee of that company. 3.The regulation is absolutely true but applicable to those employees recruited by Govt and appointed by the Govt.

There is no irregularity in your pursuing the regular course of study.
