Sir in 2005 my senior officer and me for 500 trapped by lokayukta police in that senior officer demanded money and I had taken it. I am A2. The case was my favor in 2005 at district court and 2012 also my favor in high court after it had gone to departmental enquiry they made me complsary retirement then I filled KAT they upheld the copulsary retirement. Then I had filled in high court in judgment they reduced funishment into withholding 5 annual increment with cumulative effect but I have only 2 years service left

It is left to the discretion of the authority, and they may view it leniently and be satisfied by withholding only two increments or reduce one past increment.

What is your query? Has the Department taken you back in service, thus implementing the High Court decision? If not, there is chance the Department may move the Supreme Court.

<p>You cannot be promoted as long as increments are with held</p><p> </p><p>You have not stated whether high court order is in 2021 or the effect of reduced penalty starts in 2021.</p><p>In case the reduced penalty has an effect from 2016 the then you can be promoted when increments are released.</p><p> </p><p>In case reduced penalty is effective from 2021 then can be promoted in 2027.</p><p> </p><p>In either case the promotion of juniors shall have no relevance and you will not be able to get the seniority above them .</p>
