Right over property of my maternal grandparents.

Respected sir,my maternal grand parents had 3 children,one daughter and two sons,my mother is the eldest. My grand father passed away in 2000,my grand mother passed in 2006,after that both sons split and shared the property after a long dispute.

Both uncles and their wives would illtreat and harass my grandparents for the property and my mother would take care of them.2 years after my grandmother, my mother also passed away in 2008.

Now my question is can I get share in my grandparents property if I proceed legally?

Hi,

If such property is not ancestral but your maternal grandparents’ self-acquired property, the distribution would be governed by intestate succession if the same has not been bequeathed under a valid Will. 

You could make a case for your mothers share of the property as she was not given her share according to the Hindu Succession Act. Note that your mother’s share in the property would then be equally distributed amongst her class-1 heirs(You and any of your siblings)
