Under the Hindu Marriage Act, the basic grounds on which the Hindu women can seek the remedy of divorce are Adultery, Desertion, Conversion, Leprosy, Cruelty etc.

However, under Section 13 A & B of the HMA the parties may seek decree of divorce by mutual consent when either of them is deaf & dumb and/ or unable to read / write, there is no legal impediment.

Dear Querist,

 

In the case of Ajitrai Shivprasad Mehta vs Bai Vasumati on 20 June, 1967 The petitioner husband has filed this appeal under the Hindu Marriage Act, 1955, hereinafter referred to as "the Act", as his original petition for obtaining decree of the nullity of his marriage or for divorce had been dismissed by trial Court. The petitioner is deaf and dumb from the birth. The petition is acceptable.
