Is forgery cognizable offence

Dear all,

Is forgery cognizable offence and police ought to register Fir without permission of magistrate?

A Layout developer as attorney has obtained a gpa from illiterate land owner who is adcent to our property.

In GPA, our property has been included  along with neighbors property for management of property and sale of property.  Neighbor was illiterate and his tumb impression can be seen. Several places whitner is used to insert our property no.

GPa is recently found. One 3rd party, as attorney has sold several sites with mention of our property no. And as gpa holder of neibghour though he is not a attorney. The neighbor is deceased and none from his family are witness to the GPA, even is thumb impression is questionable.

Hence , the GPA can be said as forged document or fabricated document. Is this offense cognizable for police to registrar fir. Please Guide.

If you are affected and if your property has been encorached or grabbed based on the GPA which includes your property also by alleged act of  forgery then you can fight for your property alone, you cannot fight for the property of your neighbor which has no relevance to your property.

You have avenues open in the criminal law as well as the civil laws to retrieve the property you allege to have been encroached or grabbed by the Power agent

Conveyance of immovable property through GPA granted to third parties has since been rendered unlawful.

Yes sir, i want to file criminal complaint for my property alone. So is forgery in this case cognizable offence or non cognizable offense for police to file FIR.

File a suit for declaration and a police complaint through a local prudent lawyer, as advised by experts, which I fully agree and appreciate

Cognizable or not and to take appropriate legal action on the complaint depends on the police further action in this regard.
