Booked for stolen phon..

I unknowingly bought a stolen mobile on 21march2023. Police came ON 30th may 2024 , i gave them the stolen mobile and booked me under ipc 356 ipc/379/411/

Ipc34. No arrest was made but told me to come delhi whenever they ask . Police told that nothing much will happen as they will CONVINCE the other party to have mercy on me as their stolen mobile is already received . And told me there will a court hearing and u will be fined an amount. THATS IT

I am an innocent transgender person.

Whats the worse can happen if police filed a chargesheet or they are delivering lies

Section 411 of the Indian Penal Code (IPC) deals with the offense of Dishonestly Receiving Stolen Property. This section is a non-bailable, cognizable and non-compoundable offense, which means that the accused can be arrested without a warrant and the case cannot be compromised between the parties.

If you purchased a stolen item, you may face criminal charges–especially if you knew the item was stolen

If ther complainant is not pressing for the complaint then you may compromise and proceed accordingly as advised by police

Thanx for the reply dear sir ,

What do compromise mean , that the complainant can say " its ok, he is innocent, let him go ! " To police ?

If they compromise hopefully, shall i face any jail time and case hearing then too ?

If the compromise has been arrived then the police will close the case by filing closure report  and the complainant will be advised to express no objection before magistrate when summoned for recording his objections for closure of the complaint

Thanx sir , i am really hoping the complainant will compromise . 

As i belong to transgender society we dont do such stuff or anything illegal . I was fooled by a theif as he provided phone n bill to me n i beleived him . 

Mrp of mbl was 30000 , bought it in 12000 , 6 months old mobile .

You have faith in God, you will be blessed and will come out without any problem once the compromise process is  completed successfully,  you will be freed from the unnecessary troubles that you have been implicated.

411 punishment can be hree years jail or fine both.

379 punishment can be hree years jail or fine both.

Both are non-bailable. but compundable at the mercy of the owner of the stolen property,

Hi sirs,

Last week i went to delhi police station .

They only put "ipc411" on me now rest ipc were dropped.

They took my 3 snaps + fingerprints and made multipage chargesheet (ithink)

The iO (2star inspector) and Head constable said dont worry abut this case anymore 

As they have already handed over the *stolen* mobile to owner and they will ask them now to withdraw FIR (that they will do) . 

Plus they didnt give any "show notice 41a" or some document to me .

At last the HC said he will visit me "casually" someday if he come across my area . 

 

What do you think sir , is this case is really over now ?

Whoever dishonestly receives or retains any stolen property, knowing or having reason to believe the same to be stolen property, shall be punished with imprisonment of either descripttion for a term which may extend to three years, or with fine, or with both.

However if the complainant compromises then there are chances to get out of the case without any injury
