Law: You may not have an ice cream cone in your back pocket at any time.

Why would you have an ice cream cone in your back pocket in the first place?

Law: Moose may not be viewed from an airplane.

Isn’t it highly unlikely for the human eye to view a moose from an airplane? Nevertheless, expect your eyes to be scooped out if you break this law!

Perhaps manufacturing original cocaine is no longer illegal. The creator of this law might just be on crack.

This is law is pretty much going against the Bill of Rights, tarnishing a single, very happy man’s life, pushing him for marriage or to pay taxes, quite the same torture in a varying degree!

Ever heard of rail diversion tracks? Modern modes of commuting allow two trains to divide their tracks if they pass one another. On the other hand, obviously if that was not a possibility, no one would want a collision!

It’s like saying that if someone is comfortable with the main door of their home open, is going to be charged for committing the freedom of doing such an act.

In India

For claiming Adverse Possession : One sould be hostile, notorious, open exclusive etc., if all these elements are present then u may declared owner of the property aginst the true owner.

Does not being hostile and notorious attract any section of IPC.

Other thing If someone has dispossed someone and enjoying the property PEACEFULLY with knowledge of true owner - Is it not provocative action.

True owner reluctant to take action - Is it thinkable, either notorious unlawful tresspasser is a muscle man, or true owner is awsomely engaged in some other action. Should not the true owner be asked why he is not taking or failed to take  any action, before validating the possession to tresspasser?

If tresspasser remained their for 12 years and true owner  fails to .take any action, our law will validate the title to tresspasser - How court can validate the illeagal act of a rank treepasser?

My sincere thanks to Mr. Assumi sir and Madhuji for encouraging complements. I will start a new thread very soon in "CIVIL" section in which I will post some of the judgements on Adv. Possesssion.

A person files a petition to invoke Section 144 of Cr.P.C.  Since his property and his life is in danger. Police reports that there is apprehension of breach of peace. Thus section 144 got invoked. The opposite party disobeyed the order. First party complained it to police. Police too found Disobedience is there by the second party and submitted its’ report.

 

Section 144 of Cr.P.C. is a Magisterial (Executive) order and breaching/disobedience of it attracts Section 188 of I.P.C.

 

Now as per the rule it is the First Party who has to file a case against 2nd party under Section 188 of I.P.C. in the court of Hon.CJM.

My question is it is a Disobedience of order of Executive Magistrate, then why first party has/needs to file a criminal suit under Section 188 of I.P.C. in the court of Hon.CJM.? Why not state files the suit? If first party does not file the suit, then does not it called to be a Disobedience? and else 2nd party will remained unpunished.

IPC 376. Punishment for rape.--

(1) Whoever, except in the cases provided for by sub- section (2), commits rape shall be punished with imprisonment of either descripttion for a term which shall not be less than seven years but which may be for life or for a term which may extend to ten years and shall also be liable to fine unless the woman raped is his own wife and is not under twelve years of age, in which case, he shall be punished with imprisonment of either descripttion for a term which may extend to two years or with fine or with both:

 

But when commited by Police and Public servants then " Provided that the court may, for adequate and special reasons to be mentioned in the judgment, impose a sentence of imprisonment for a term of less than seven years."

 

Why less punishment is prescribed for Police and Public servants for the same crime? Rather it should have been more becoz they are meant or get posted to  protect the weaker section not to commit offence themselves.

 

Also "woman raped is his own wife and is not under twelve years of age, in which case, he shall be punished with imprisonment of either descripttion for a term which may extend to two years or with fine or with both."

Whereas "   Marriageable age of a girl is  – 18yrs."

Mr.Jayaswal, pls read Sec.376 I.P.C. properly before passing your scurrilous comments on Indian Law. Section 376 clearly states under sub-section (2) that if a police officer, etc., etc., (listed therein) commits rape, shall be punished with rigorous punishment for a term which shall not be less than ten years but which may be for life and shall also be liable to fine.

COMMON MAN - Maximum Punishment is 7 years.

POLICE OFFICERS, ETC. - Minimum Punishment is 10 years and Maximum Punishment is LIFE IMPRISONMENT.

PLEASE DON'T MISLEAD LCI MEMBERS.

Sir I have gone thro' the "CRIMINAL MANUAL" of Professional Series by Justice M R Mallick. A shedule is there in the book.

As per the indiankanoon.org the act is as below-

 

376. Punishment for rape.--

(1) Whoever, except in the cases provided for by sub- section (2), commits rape shall be punished with imprisonment of either descripttion for a term which shall not be less than seven years but which may be for life or for a term which may extend to ten years and shall also be liable to fine unless the woman raped is his own wife and is not under twelve years of age, in which case, he shall be punished with imprisonment of either descripttion for a term which may extend to two years or with fine or with both:

1. Ins. by Act 18 of 1924, s. 4. 2. Subs. by Act 43 of 1983, s. 3 for the heading" Of rape" and ss. 375 and 376.

Provided that the court may, for adequate and special reasons to be mentioned in the judgment, impose a sentence of imprisonment for a term of less than seven years.

(2) Whoever,-

(a) being a police officer commits rape-

(i) within the limits of the police station to which he is appointed; or

(ii) in the premises of any station house whether or not situated in the police station to which he is appointed; or

(iii) on a woman in his custody or in the custody of a police officer subordinate to him; or

(b) being a public servant, takes advantage of his official position and commits rape on a woman in his custody as such public servant or in the custody of a public servant subordinate to him; or

(c) being on the management or on the staff of a jail, remand home or other place of custody established by or under any law for the time being in force or of a women' s or children' s institution takes advantage of his official position and commits rape on any inmate of such jail, remand home, place or institution; or

(d) being on the management or on the staff of a hospital, takes advantage of his official position and commits rape on a woman in that hospital; or

(e) commits rape on a woman knowing her to be pregnant; or

(f) commits rape on a woman when she is under twelve years of age; or

(g) commits gang rape, shall be punished with rigorous imprisonment for a term which shall not be less than ten years but which may be for life and shall also be liable to fine: Provided that the court may, for adequate and special reasons to be mentioned in the judgment, impose a sentence of imprisonment of either descripttion for a term of less than ten years. Explanation 1.- Where a women' s is raped by one or more in a group of persons acting in furtherance of their common intention, each of the persons shall be deemed to have committed gang rape within the meaning of this sub- section. Explanation 2.-" women' s or children' s institution" means an institution, whether called and orphanage or a home for neglected women or children or a widows' home or by any other name, which is established and maintained for the reception and care of women or children. Explanation 3.-" hospital" means the precincts of the hospital and includes the precincts of any institution for the reception and treatment of persons during convalescence or of persons requiring medical attention or rehabilitation.
