COMMENT ON THE FOLLOWING
IPC, section 497. Adultery Whoever has s*xual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such s*xual intercourse not amounting to the offence of r ape, is guilty of the offence of adultery, and shall be punished with imprisonment of either descripttion for a term which may extend to five years, or with fine, or with both. In such case the wife shall be punishable as an abettor.
498. Enticing or taking away or detaining with criminal intent a married woman Whoever takes or entices away any woman who is and whom he knows or has reason to believe to be the wife of any other man, from that man, or from any person having the care of her on behalf of that man, with intent that she may have illicit intercourse with any person, or conceals or detains with that intent any such woman, shall be punished with imprisonment of either descripttion for a term which may extend to two years, or with fine, or with both
These sections clearly give the benefit to a wrong doing woman in such a situation and treats that woman doing this crime as innocent even when every one knows that she is not, while treating the man guilty even if he is a victim of the act of such a woman! Also it gives a right to a husband to allow his wife as an object that can be used by another man with his consent! If a woman has physical relation with a married man, his wife has no relief! Also, if any other woman entices away husband, wife cannot force him back or have the other woman is punished.
This is against Article 14 of the Constitution of India.
