Cs filed but not yet recieved it

I am 33 years old and my wife of the same age as mine had filed 498a case against me months back. It has been 2 months now since (as per the police) the CS was filed. I am yet to get any letters for summons / call to attend court to get the CS copy. My lawyer had checked ( at least he says that) in court and as per him CC number is not yet assigned. He can get the certfied copy once the CC number is generated.

Questions:

1. Is it normal to not get summons after almost 2 months of CS filing by police ?

2. Will summons (I assume it will be via post) be sent to my address ?

3. Should I go and check in PS if at all they have filed the CS, OR go to the court and check ?

4. I checked in the ecourt site. It doesn't show any dates as well. Will the ecourt site get updated " with that date" once they send the summons for me to appear on that date ?

Could you please suggest. Thank you in advance.

1. It can take more time also because of courts are overburded 2. Yes, 3. Go to the office of the concerned court and enquire from the clerk he will give you the exact position 4. make a close contact with your lawyer tell him to keep checking your case status .

I have a query in addendum to this. How accurate/reliable is ecourt website?

We were presented with chargsheet in court (JMFC) last week and got bail.

the ecourt site shows next hearing date as few months later. Does it mean that next appearence will be on same date?

@Fight...: Please remember that once a charge sheet is filed before the court the court will send you summons to appear before the court to your registered address in the FIR or the one available in the charge sheet. You may also be in touch with your lawyer to know the present status or alternately, you may visit either the court office and enquire the status or the concerned police station to confirm the status.

@Rajesh Kumar: The court web sites are generally getting updated on day to day basis except under some extra ordinary circumstances where the concerned staff is not available to post the entries in the web sites.  So you can go by it or can clarify the same through your lawyer too.

I had gone to court to check on the case status. The clerk has told me told that CS from police was received 2+ months back. Till date, CC number not yet allocated. Once CC no is given, summons will be sent to me. Is it normal for court to take that long to create CC no. and send summons?

Thanks in advance.

Respected members,

Is it normal for court to take more than 2 months (chargeheet received 2+ months back) to create CC no. and send summons in this 498a case?

Is there anything that can be done to speed up the process ?
