it is indeed strange - i find that most of the PIOs do respond when CIC sends a notice.

but i think that the written notice will prevail over the online version - i think our lawyer friends on the forum will clarify on this point.

if the written notice contains the penalty statement, then surely the PIo Would respond. after all, who would lose 25,000 salary if at all the penalty is certainly imposed.

otherwise, i think the best alternative is to move the secretary general or Mr.Wajahat habibullah, the CIC himself about this.

if they also do not respond, the only alternative is to file a writ petition. what to do? our authorities are in a deep slumber most of the times.

i will cite my own case here: i submitted a second appeal to CIC against an AA order way back in sept 09. the website showed signed copy of appeal is needed. i sent it next day by courier and they received it but did not update the website and did not take any action on the appeal. i sent a registered letter which they received and again there was no response. i sent several emails but again there was no response.

exasperated, i sent a third regd letter to both their offices (to add to the confusion, they have two functional offices) which was also received. frantically, an appeal number is given and  the website says that appeal is under scrutiny and is admitted. but the earlier appeal is still shown as "signed copy not received"

i sent another mail requesting them to consolidate both matters to one appeal but there is no response till now.

i fully agree with mr.agarwal that CIC has to tone up its own office upkeep. who is to bell the cat one does not know.

if mr.agarwal is unable to attend the personal heraing, one can always schedule a video conference. they hear many outstation appeals and complaints that way. even i have to resort to such method only. one cannot go to delhi all the way just for this appeal.

Sub: COMPLAINT AGAINST THE WORKING OF CIC

 

Sir,

 

Kindly refer to my complaint dated 2/8/2009 (by email) and 3 AUGUST 2009 (hard copy) and 9 SEPTEMBER 2009 as also the letter No.11/5/2009-IR dated 16 NOVEMBER 2009 from the Department of Personnel & Training addressed to you regarding manipulation and forgery in the records of CIC to protect a CPIO of Ministry of Health and Family Welfare.

 

In reply to my email dated 2/8/2009, you informed me in your  email dated 2/8/2009 that

“HAVE TAKEN THE MATTER UP WITH MY COLLEAGUE”

 

Subsequently, Shri G. Subramaniam, Assistant Registrar, informed me that the inquiry into case No.CIC/PB/2008/635 has been entrusted to Mr. P.K.P. Shreyaskar. I have been sending emails and writing to him to let me know the action taken in the matter and the result of the inquiry. To this day, no reply has been received.

 

Why no reply has been received is now getting more transparent now. When I sent an email to the Secretary of the Commission on 17/11/2009 requesting him to let me know the name and designation of the person in the CIC in whose favour  I should draw the Indian Postal Order for being attached with my application under section 6(12) of the RTI Act, 2005, instead of sending a straightforward reply to a simple query, and to my HORROW, he forwarded my email to Mr. Tarun Kumar, Joint Secretary & Additional Registrar, asking him to:

 “Please inform Mr agrawal about in whose name the IPO has to be drawn as also alternative mode(s) of payment available to him as per rules.”

 

Neither the Secretary nor the Joint Secretary has cared till this day to send me such an innocuous information, which otherwise should be available in the website of the CIC. It goes to the credit of Mr. Shailesh Gandhi, Information Commissioner, to send me the requisite information in a jiffy and without the bureaucratic muddle. I am ashamed that an Information Commissioner had to be approached for such a piece of information and your officers thought it below their dignity to send a one line email.

 

The two diametrically opposite orders were passed on 28/11/2008, notices were not served on the CPIO, he did not attend the hearing nor did he care to the CIC’s notices alleged to have been served on him on 27/5/2008, 25/8/2008 and 4/8/2009, after I made the complaint, the earlier order uploaded on the CIC website was withdrawn and another order uploaded and no inquiry is concluded and responsibility fixed. All this goes to show that the CIC, which is empowered to administer a transparent regime, too has become like any other government department where records are manipulated, protection is afforded to the guilty persons and our complaints and letters are ignored. Clearly, a nexus exists in the CIC to protect guilty CPIOS.

 CJI is complaining to the PM. Maharashtra State Information Commissioner is complaining to the Chief Secretary.

Can I complain to my neighbour? Alternatively, to my wife?

sorry if this reply is inappropriate for this thread.

one learned member has stated that there is light and hope also.

he goes onto say that rani jhansi did not see freedom but we are seeing it. 

but my question is this: are we really free? can a girl walk in the streets alone in the midnight with jewels all over her body?

what about rampant corruption, maladministration, apathy, indifference (including ours)? what about poverty continuing?

dear member, what you mentioned are absolutely true. but it is also a true that, we are fighting against corruption continously, our critisism will be frutile in future. as an elder person, i,myself, and many of our comred friends will not be seen that golden days, but WE WILL GET IT MUST.

now rti itself becoming a terror to the corrupt people. they are trying to be escaped from it. we need more rti activists. we know that there will be more blood shed for the hunger of rti.

we must know what the wrong going on in government & outside the government. after passing 60 years of political freedom, why our common people could not get economic freedom? we must know it by analysing the data collected by rti. it is not a job of one or two and a job of a day or 2 days. it is a contineous process and it will be continuing.

 In mofussil and rural areas, asking information under RT is courting trouble. Cases abound where the applicants are flogged or kept behind bars on false charges or threatened with dire consequences police style.

So, LONG LIVE THE RTI.
