Deceased claim

Dear All, Namaskar. 

I have just joined the forum and posting my query with the hope that i will get accurate answer. 

As my mother expired and for the Saving account (Single), i have asked bank for settlement of claim. 

I have prepared “Varisan Praman Patra” from District Magistrate Office. Bank has yet not found the Account opening form and asking to produce Succession Certificate from Court. 

Here my query is:

  1. If Bank will not found Account Opening Form to verify whether Nominee is given or not then how it can be sure for payment. Is there any rule that bank can deny for showing Account opening Form so I can verify whether Nominee is registered or not?
  2. Second thing if suppose they didn’t get Account Opening Form then where I can complain?
  3. If suppose they found form and NO NOMINEE is registered and Amount which is in account is approx Rs. 23000/- (Twenty Three Thousand) then Is it must to get Succession Certificate from Court or there is any threshold limit so Bank Manager can settle account thru “Varisan Praman Patra” only.

Kindly guide me accordingly.

The nomination is duly recorded as per declaration in a/c opening form and even later and registered in manual and computerized records.

 

The bank also keep digitalized records.

Apparently bank has not stated in writing that a/c opening form is not traceable.

Apparently you have not minuted in writing that as per BM/Mr.............a/c opening form is not traceable by the bank.

 

Apparently the amount is below the Min. threshold level set as per RBI guidelines.

Let the bank declare to you in writing about a/c opening form and its deceased depositor policy and supply you the requisite forms and procedure.

Go thru:

RBI; Master Circular on Customer Services; Section;19 & 20.

Bank's private deceased depositor policy that should be on Bank's website and BM should supply you a copy without any cost.

The bank should pay and may ask to sign Indemnity, surity, affidavit etc................if there has been NO nomination, and without it if there has been nomination.
