Hi ,

I recntly got my divorce decree in India. I stay in kuwait and I went to India embassy to remove my husband name from my passport but they said we cant accept this decree you have to get it attested by home department and ministry of external affairs in India. Is it required or is there any other way to get it attested or any other way to remove my ex husbands name from my passport. If Idont remove the name am I allowed to marry and then remove the name after submitting marriage certificate. I would like If some one could help please.

@ Author,

1.
They are right.

2. If you have added your spouse name in your passport after your marriage then it might be required for you to delete your spouse name if you are now divorced.

3. To delete name of your spouse you need to submit an miscellaneous Form for reissue of passport with name deletion along with the documentary proofs of your recent divorce.

4. Divorce certificate duly authenticated from one out of the 35 Regional Authentication Center(s) in India (if you tell me which place in India you got Divorce decree issued I can provide you with complete address of regional authentication center).

5. Once above is complete you need to rush authenticated document for attestation to one of the 5 authorised outsource agency (I can provide you with complete address of outsource agencies provided I know your home city in India) for submission of documents at CPV Division, New Delhi and they collect in 3 working days your documents and you need to collect the same from them to submit to Embassy of India in Kuwait for re-issue of Passport without spouse name which is the procedure since July 2012.

6. The process is unfortunately the same in case of re-marriage and then removing the name of ex-spouse and in my opinion it hardly makes much difference procedure wise.

Note -
No document from individuals is accepted at the Ministry of External Affairs Counter at CPV Division, Patiala House Annexe, New Delhi. The original document is to be submitted directly to the five outsourced agencies along with a photocopy of the document and a photocopy of the Passport of the applicant. Ministry will not legalize the photocopies. However, applicant can submit documents directly at five Branch Secretariats (I can provide you with complete address of five Branch Secretariats nearest to you provided I know your home city in India)
