delay in partition and situations

Hi All, Thanks for all your valuable suggestions. we are waiting for my brother in law to get partition of one site relate to my mother in law. but my brother in law is lagging from past one year and now he is not ready to come forward for partition.Property title is clear and only 2 legal heirs as my wife and brother in-law.

Please advise on the below situations without partition:

1 If we occupy the property completely including my brother in-law share
2 if we occupy half property of our share so he will come forward for partition
3 if we get khata and property tax done in my wife so that he will come forward for partition

partition is a must for enjoy the property or sell the same. Though there is no legal prohibition on selling undivided share of the co sharer in the joint property , the buyer without physical partition of the property can not take possession of the same.
