Delaying 125 crpc - any issues foreseen

Hi Seniors / Experts,

My wife has filed 498a and package against me, my parents, relatives in Nov'11. She filed for maintenance U/s.125 CrPC and I received the petition in Feb'12. Magistrate asked me to file counter by March'12, but I didn't file and requested another court date (and was granted). I need to file the Counter by April 19th 2012.

But I want to request for one more court date to file the Counter as the ChargeSheet for 498a case is NOT yet filed. Do you foresee any issues / problems If I prolong/delay filing counter against 125 petition.

1. Will I be given another court date for filing counter or not ?

2. Am I liable to pay fine if ordered by Magistrate?, If so, how much?

3. Or will the magistrate issue ex-parte in her favour?

Please advise.

Thank you Shonee sir. I heard that some of our brothers fighting 125 CrPC have delayed filing counter for 3-4 court dates and paid fine of Rs.100 each time they delayed. I wanted to do the same so that CS is filed in between and will get to know all of their intentions. Would this be a good idea or shall I just file my counter? I don't want them to get things done so easily, I want the other party to be confused. So, please suggest. ~Krishna
