what is the time frame for a disciplinary authority to close the case after issue of chargesheet. Any time frame for starting departmental enquiry after charged officer submits reply.
Anjuru Chandra Sekhar (Advocate ) 11 May 2012
There is no such time frame, but if an employee is kept under suspension and departmental inquiry is prolonged to abnormal periods of time, the employee is eligible to get subsistence allowance. And after suspension if the departmental inquiry does not conclude within a reasonable period of time, the suspension will be viewed as malice. However the words like "reasonable period of time" are vague, no definition is given for such phrases anywhere.

no fixed time frame has been fixed for completion of the deptl enquiry. however a reasonable time is assigned for its completion by the disciplinary authority. the employee if under suspension is entitled for the subsistence allowance. too prolonged deptl enquiries spell out a sense of malice towards the employee.
