District consumer forum process reg

1)  In a District Consumer Forum case that is being heard, I need to bring recent sequence of events/facts to the forum's notice that transpired after filing the complaint and evidence, that would help build my arguments. What is the appropriate method ?

2) If it is Memo, what should be its contents and order of their occurance? Can I attach evidence to it in support of same? Sample format, if any would be beneficial.

3) Can I present the same to forum in next hearing ?

4) Other Party is reluctant to file their evidence in last two hearings. How to expedite Judgement pronouncement ?

Expert advice highly appreciated. Regards.

1) You can file an affidavit in the District Forum.

2) The contents would be same as what you want to submit.. The order can be chronological or in the order of importance according to you. There should be no mix up and confusion.

3) Yes. But it would be better if you submit the papers in advance of the hearing, with the same number of copies as you would have been required for your original complaint. At the hearing you can draw the attention of the Forum to the affidavit filed by you and also give an oral presentation.

4) Since you yet want to present some material, you cannot complain at this stage. If the Opposite Party does not file anything, but appear at the hearing on their own or through an advocate, their oral presentation, if any,  would be taken as their submission. In the first place the opposite party should appear before the Forum. The Forum would have sent copy of your complaint to the Opposite Party. The Forum will also wait until the postal acknowledgement is received back from the Opposite Party. If the Opposite Party doesn't appear at all, the Forum may decide the case on merits.
