Back ground : wife left matrimonial home due to difference in opinion and her parents took her to their house, leaving the children under my custody since 2013.
Initially wife filed DV and withdrawn the case, then she filed Child custody case in family court. Aggrieved by this, I filed divorce case against wife. In child custody case children were examined by the court and they expressed their willingness to stay with me(husband). wife got visitng rights (orders yet to be passed). When wife visited the children she expressed her desire to rejoin matrimonial home but the divorce filed by me is a hurdle for her. she is 45 and children are 15 and 13 female and male. I am around 49.
I have a lot of hesitation to call her back due to lot of false allegations, from her from her parents, brother , relations side etc., during these days in written pettition and in court. All bitterness happened by way of mouth and petition. Still I am also of the opinion that she has not completely realised. her parents are the villons in this case. If I withdraw my divorce case, I also have a fear if she files a DV case, or if she files any other case.
Can I get a written statement from her, that all the allegations made by her so far is false whether this is legally valid. and then ask her to rejoin what will be repurcursions on this.
