Divorce

Hi,

I had married a girl through registration 4 months back with the consent of both our parents and relatives. It was a arranged marriage. After the registration process was over we continued to talk over phone occasionally and found out that we had lots of differences in thoughts and beliefs. We never stayed together and also met each other in person after the registration. Hence we had decided to part our ways. Please let me know the legal procedure for this.

Move a joint petiion seeking mutual divorce before family court through a counsel and make your initia statement and thereafter again come after6 months and confirm to your earlier statement and get a decree of divorce.

.This is not a matter of divorce,this a ground for annulment of marriage that tthe marriage was not consummated.You should file case under section 25 of The Special marriage Act for nullity ground to dissolve the marriage.If  you file a divorce suit it would be established in law that the Marriage was duly consummated and you have to pay alimony also.

agreed with Mr.Bhadra, as you are still in the limitation for filing the annulment of the said marriage.

But before going forward you need to make her understand and convince her for that otherwise it will be a big show for you and her which ends after spening a lot of money and time.
