Divorce

one of my friends due to his wife mental cruelty is living separated from 2011 beginning...His wife too left his home & went to her father's home & there was no contact....Both families agreed on MCD but now the girl turns off.......now she is back again...to live with him & to torture more as because when she came to live again she got police as security referring that she is being tortured by her husband & in-laws...to warn them strictly...After that again my friend left home & living in lodge from this july....He is soon to shift in other city....I want to know 

1.Can he file for divorce in that other city after he leaves his own city..?

2.What will be the procedure for that?

3.He is even thinking of changing his surname ..Whether that will effect?

If he doesnt want to live with her anymore file for divorce and judicial seperation. 

whats wrong filing in his own city.

why is that he want to change his surname???

Your friend has got grounds to file a divorce case on the grounds of desertion and cruelty provided he continues to reside in his own city because it is this place that his wife deserted him and not the new place and in case of he shifting to new town, he should have informed his wife about this asking her to join him in the marital voyage either through his lawyer's notice or otherwise.  It seems he is trying to escape from his marital obligations by shifting his residence to some other place avoiding his wife to live with him together and if he chooses to do so, he must prove the strong evidential reasons of his allegations namely cruelty by his wife to him.  If he is able to prove that there were no cohabitation between him and his wife for a period of more than two years and that she is not willing for that, he can proceed with a case for divorce against her, ask him to contact a prudent lawyer on the subject and proceed as  per his guidelines.  Advocate Kalaiselvan, Vellore, ph: +919443441062
