Application is filed under 13B (Mutual Consent). Two Lacs is given through Cheques to wife as one time settlement. One time Maintenanace. Now wife started to demand more money. Husband is not capable to give. What will happnen if she is not present on 2nd motion? (At the time of order) Will HOn'ble Court make order to refund money if she is not ready for mutual conset? Or any other remedy for husband?

Check wheher she is ready of DMC anymore.. If she is not them file a petition for divorce and mention about the terms decided in mutual consent application and the paid money.
