Documents/ exhibits in mumbai high court

My parents had a property dispute case going on in the Mumbai High Court around 1990 They were trying to evict the tenant who was refusing to leave our premises. The matter was subsequently settled out of court in 1993. But during the proceedings of the case, I think the judge had requested myparents to deposit property documents with the Mumbai high Court as exhibits to the case.

After the final settlement decree, my parents did not apply to get the documents/exhibits back. Is there a way to check if the documents are still with the court after more than 20 plus years?

I am seeking advice from experienced advocates who have knowledge and prior experience in this area as to how to get the documents/exhibits back.

First you may file RTI Application to Public Information officer menting the case No and the sale deed details available and seek copy of  procedure /laid down norms for getting return of those documents.  The advocate who has taken up your early matter may guide you. Search HC website for RTI rules and regulations in format of application and stipulated RTI fees and mode of remittance.

You can contact the office of the concerned court with the case details and engage some official to make a search in the registers preserved by them after which you can apply for return of documents either through your own advocate or by yourself as a party in person if you were a party or by your father if he is alive or by his legal heirs with authorisation  by other LRs in favor of one among them.
