Does indian pvt bank exercise "bankers lien and right of set

 

Dear Member ,

I’m holding a Credit card and payment made on due date i.e Oct'2010.But surprisingly I receive next monthly CC statement i.e Nov'10 showing interest of Rs.189/- as a let payment .Immediately I contact customer care and informed about it. No appropriate reply on the same. Then I stop using CC and repeatedly I called customer care and asked for clarification as because every month I’m receiving statement of account with accumulation of previous month interest . On 17th Oct.2012 I received a letter from CC department that total accumulation interest Rs.10987/- on hold from my current a/c from the same bank and said amount being debited 02nd Nov 2012 .They mention on their letter they're exercising "bankers lien and right of setoff'.

Does Indian Pvt bank exercise "bankers lien and right of setoff' in such a short period of notice ? In this situation can I file a case against bank ?

I appreciate your advices and suggestions. Thank you  .

BTW : Credit Card not linked with my current a/c .
