my marriage happened in 1988. since marriage itself there has been lot of irreconciliable differences between us. solvation effort by our relatives and friends went invain. hence due to effort of wellwisher of both families mr kumarasamy one mcd was filed in 4.10.2013 in chennai family court. prior to that out of court rs 25 lakhs has been paid to my estrange wife before our well wisher kumarasamy as permanent alimony. when i asked kumarasamy why out of court payment
he told me that as she wishes to buy one house with alimony money if money given she will fully cooperate in mcd case. but what happened is she does not attend many hearings and atlast on 5.6.2015 she withdraw her consent and my case is dismissed. the lawyer join hands with my estranged wife and he does not filed money paid receipt along with other documents at time of filing mcd case. judge dismissed case and she does not accept to file money paid receipt.
i am in dark and 2 years has been passed since date of dismissal. now i have to give condonation of delay application along with appeal application. my humble question is as am in poor stage and as i am a pensioner if i wish to appear as party in person in my appeal what court fee i have to pay and also other charges as i have paid 25 lakhs as permanent alimony out of court?
as i dont know about suit valuation act in india and
my another question is for condonation of delay what justifiable causes can be quoted in my condonation of delay application as along with other responsibilities i have to look after my old mother of 80years who have been ailing with cancer and so many diseases.
