Employer harassment issue

Hi Need to check if an employer doesn't relieve you even after serving the notice period on the ground of market outstanding. What would be the implications? whether they are legally right in this? The major issue is they are not paying the salaries from last 5 months to the employee and then the employee wants to leave they don't relive him on the grounds of market outstanding. Please let me know the legal right of an employee on this.

employee cannot leave leave it with old your salaries on Grounds of outstanding dues in the market and it is completely illegal.

You should serve a legal notice to your employer asking them to clear your lawful dues along with interest, within 15 days of the receipt of the legal notice.

If they fail to do so, you can approach Civil Court by way of a recovery suit. alternatively you can also approach National Company Law board if the dues are more than 1 lakh.

For any other queries feel free to contact me at isidjain1@gmail.com

It seems that the employer thinks his employees as Gulam! It is completely illegal. Please serve him a legal notice.
