EP

Dear Experts, Filed EP in Partition Civil Suit in District Court. Opposite party appealed in High Court, but no stay for over 1 year and case is also not proceeding. Meanwhile in district court they have informed that Mediation is pending in high Court. District court jugde has asked for the mediation report. Would like to know whether Mediation report or any enquiry is required for EP proceedings. Also since stay is not there, will EP proceed quicker. Kindly reply.

Sir, In district court, Final decree passed in our favour and we have filed EP. In high Court appeal by the other party, Judge has asked two senior lawyers to talk to both parties and revert, which has not happened and pending for an year. This they have mentioned as mediation pending in high court (No formal passing over to state mediation centre).

If highcourt grants stay then let they submit it to court. So press the court to pass orders

Dear sirs, Lower court Hon. Judge informed that since the case is in mediation stage, the same will be kept on hold, until case moves to next stage in high court. In high court case is not moving and is not dated. How to proceed on lower court. Kindly advice. Also in a particular property (shops rented) , the other party is using our building staircase to go to their first floor even though they have their own staircase at back side. This they are doing it for long by breaking small side wall. Kindly advice whether I can build the small wall, which comes on first floor of my building.
