Eviction of old property

A shop was given  to a firm more than forty years back.@ 28 rs /month.

The shop was taken over by son of one of the partner and he opened another firm in the same shop some thirty years back.

he has never paid any rent to us.........rather on demand he deposited rent for twenty five years in court, and not to us

also he posted a dd to us as a rent for four years, that was being accepted by land lady(sole owner of the property, )in ignorence

presently the property, which is three storey bldg, and rental shop at ground floor only  , is in a dilapidated state

he is presurring us to sale the property  

WE WISH TO KNOW WHERE DO WE STAND..........AND HOW CAN WE GET THE PROPERTY EVACUATED

 

P.S:-after heavy downpores this year , there were some water problem in shop, for which he reported to police for malafied inrentions,

Dear Sandeep Jain,

Why haven't the landlady initiated eviction proceedings, so far.

What is the present rate of rent per month?  It is necessary to decide the forum.

Is there any written and registered lease agreement?
