Divorce decree passed in the absence of the respondent is ex parte decree i.e., when the respondent had not filed his appearance in the court to contest the case.

Ex-parte is an expression used to signify smething done or said by one person not in the presence of his opponent.  This term is applied in law to a proceeding by one party in the absence of, and without notice to, the other.  On or from one side only.  Ex-parte proceeding  at the instance and for the benefit of one party only and without notice or contestation by any person adversely interested.
