Ex parte order

In 2008 mumbai family court passed ex parte order on grounds of nullity Is there any chance now to file a appeal against the order in conde delay and cancel the order

Ex-parte order/decree can be always be set aside by moving application under order 9 rule 13 read with section 151 CPC in the trail Family Court anytime, as no time limit provided as such under the said provision, delay if any can too be sort to be condoned by stating reason for the delay.

The trail court will consider your application and will decide if the decree of nullity be set aside and the matter reopened once again by allowing the respondent to file the reply/WS to the nullity petition and defend the case.
