Ex Party Divorce

Dear All,

I am seeking the advice in my legal case, first of all the following are the contents of the case.

1) I got married in April 2002 in Mumbai

2)I started to live with my husband in a rented house in July 2004. In the mean time my in laws debarred me and my husband from their assets/property by publishing the notice in the newspaper.

3) My husband left the house in Oct.2006. Till Date I don’t know his whereabouts.

4) In Jan.2006, I filed the case for maintenance, dowry and domestic violence against him and his family.

5) Till Date boy has not appeared in any of the case, while his family is appearing in all the case. They have got the bail from the court in the cases of dowry harassment U/s 498 A.

6) I have filed a divorce case u/s 13 (a) (b) in Jan.2010, the boy has not received the summons three times sent on his parents address. Now the court has ordered to paste a notice on the given address.

I want to know,

a) How much time the court will take to give me the ex party divorce.

b) Can he ever challenge the decree of the divorce issued in this case.If he does not then what will be the case.

c) Can i remarry after getting the divorce?

d) If after taking the ex party divorce, I will have to appear in the other cases. if I don’t appear in those cases, what will be the consequences.

Kindly advise me on the above points.

The law works on both sides. it was your turn to slap cases under 498 and domestic voilence against your husband and inlaws who must have got arrested and suffered the agony.

Now the boy by disappearing has done extreme sacrifice by leaving his abode and accepting the unsecurity of this cruel world.

So now divorce or no divorce your earlier life will be a hanging sword on you for the rest of life.

Exparty divorce can be challanged at any time during your lifetime particularly if you choose to remarry.
