Also, should i insist court to action on my application under Crpc 475 for transfer the case to Defence for trail by Court Martial which is unactioned yet coz judge said that she has to speek to her seniors.

If you are defence personnel and accused of criminal action and if the said crime would also have been a crime triable by court martial then the transfer of case would have been sought by the For (Army/Navy/Air Fore) after sanction of competent authority.  Individual has no choice in this case.

As far as damages is concerned first try to get yourself out of the case as you are on receiving end.
