A person lodged DDR on 5.7.15 against three of us .We four senior citizens were sitting in encroached portion of park adjacent to complainants house .One of the resident commented on encroached park which led to heated argument with the compainant..The remaining two of us helped to stop further escalation of argument . We all walked away thinking matter is over.But the complainant filed false DDR against three of us in which he stated that we entered his house and tried to beat him up and while his wife shouted we ran away.Content of his letter sent to police were totally false and wrong.He further circulated in colony a copy of his complaint which he gave to police .In that he added ," Shriman Pardhan of colony (who is inimical to us ) mere sath ghatna hui hai or main aap ke doara colony ko batana chahta hoon ke uprokat anti social elements colony mein Gunda Gardi faila rahe hain.In se colony niwasi on ko sachet kiya jaye ".The above contents were photocopied and circulated in colony thru a courier.
Two of them who argued /fought compromised thru police .
Two of us are retd colonels over 70 years of age .We dont want to leave it here.
We want to file defamation case criminal and civil for compensation. Under what all IPC sections should we file a case against him.Can this case be filed only in lower court or can it be done in High Court also?
We want to file case fast enough not to give any reaction time to him.Police has given us in writing that we two are not involved in any argument etc.
