Framing of charges

if some one submits criminal review petition in session court against framing of charges and did not find justice then can he move directly to supreme court without going in high court?

@Querist,

 

No, you cannot go to the supereme court directly unless there is a breach of your fundamental rights.

 

In cases where your fundamental rights are voilated, you can directly approach to the supereme court and filing appropriate writ-petition under Article 32 of COI.

Dear Querist

I don't Think so that there is any procedure for review in Criminal matters, the revision petition can be file before the court against the charge and if the revision petition has been dismissed then go to HC after that SC. you can not go SC directly .

Yes you may file a SLP in the supreme court under Article 136 of the Indian Constitution...But do exhaust the remedies availlable in lower courts first...
